Employee Files Lawsuit against Fox Chapel Publishing for Age and Disability Discrimination
Ray started with Fox Chapel Publishing in July 2013 as the director of sales. Now 69-year-old, Ray was never formally promoted, but internal communications and press releases often referred to him as VP of sales. Furthermore, Ray recalled that the president often informed him that he was pleased with his work.
In September 2016, Ray required a surgery for cancer. He informed his employer about the upcoming surgery, and also assured the president of the company that he intended to fill his role at the company for many more years. A few months after the surgery and Ray’s announcement of his desire to continue working, Ray noted that the president began to refer to his time at the company as being in his “last few years.”
Ray was terminated. When the president was pressed for the reason for termination, he tried to make it sound like Ray had retired. According to Ray, the president also blamed the downturn of sales for Ray’s termination, but Ray noted that the entire market had suffered and it wasn’t performance-related.
After Ray was fired, he discovered that two younger men took over his role, and then later, a man younger than 40 was hired for his role. Ray believes that he was terminated due to his cancer and his age. As a client of KM&A, Ray fights for his rights under the law.
