Employee Files Lawsuit against Chapman Auto Group for Sex Discrimination
Mark, a homosexual male, started at Chapman Auto Group as a branch manager in January 2009. He then was promoted to general manager, and Mark oversaw four rental offices. But, Mark faced harassment and discrimination for his sexual orientation. One manager allegedly called Mark “faggot.” Mark shared that he complained about this treatment to four other management-level employees, hoping that something would be done.
In response to the complaints, the manager allegedly accosted and berated Mark for having made the complaints of harassment. Mark recalled that the manager went so far as to accuse Mark in front of a customer of trying to “rip off a customer.” Frustrated by this treatment, Mark filed a complaint with the EEOC and PCHR, and he also informed the company’s HR director that he’d taken this legal step.
Soon after, Mark discovered that other employees were making comments about his sexual orientation, calling him “fucking gay” and insinuating that people would get quicker service if they “would have given Mark some.” Mark discovered that other employees were making comments about his sexual orientation, calling him “fucking gay” and insinuating that people would get quicker service if they “would have given Mark some.”Mark made a complaint. He received a letter from the company, allegedly saying they were investigating the comments, but the letter didn’t mention any of the previous harassment. Then, Mark discovered that he was going to be terminated because his location was closing their rental department. Mark noted that while he was terminated, all other employees were transferred to other locations.
Since the company failed to offer him another position within the company and terminated him, Mark suspects that he was discriminated against due to his sexuality or filing complaints about harassment.
