KM&A, Carson Lynch, LTD, and Lockridge Grindal Nauen P.L.L.P file Second Amended Complaint again

FOR IMMEDIATE RELEASE

June 26, 2014

Kraemer, Manes & Associates, Carson Lynch, LTD, and Lockridge Grindal Nauen P.L.L.P have filed a Second Amended Complaint against the University of Pittsburgh Medical Center and UPMC McKeesport on behalf of all current and former UPMC employees affected by a major data breach, adding four new named plaintiffs to this class action lawsuit.

The events giving rise to this complaint occurred in February 2014, when UPMC confirmed that confidential employee information, including W-2s and social security numbers, had been stolen from its databases and used to file fraudulent tax returns. UPMC’s most recent reports indicate that all 62,000 of its workers have been affected by this data breach.

The complaint alleges that UPMC had a duty to protect employees’ confidential information, and as a result of UPMC’s failure to maintain reasonable and adequate security procedures, Plaintiffs’ confidential information was used to file fraudulent tax returns after such information was accessed without Plaintiffs’ knowledge or consent. This data breach has also put Plaintiffs at a significantly greater risk of becoming victims of theft crimes, fraud and abuse.

Lead attorneys on this case are Michael Kraemer, David Manes, Elizabeth Pollock-Avery, Gary Lynch, Sunshine Fellows, Edwin J. Kilpela, Benjamin J. Sweet, Jamisen A. Etzel, and Karen Hanson Riebel. Full text of the complaint, as filed with the court, is available here: UPMC – Second Amended Class Action Complaint. The case is docketed in the United States District Court for the Middle District of Pennsylvania as a class action GD-14-003285.
