Kraemer, Manes & Associates LLC “KM&A” has filed a complaint against Best Buy Co., Inc. (Best Buy) in the Allegheny County Court of Common Pleas.
The complaint alleges that Plaintiffs were visiting Best Buy to purchase an electronic tablet. Plaintiffs asked an employee a question. The employee responded with an attack on the Plaintiffs. The employee shouted profanity at Plaintiffs for several minutes. Best Buy did not even try to stop its employee until the Plaintiffs involved a Manager. Best Buy allowed its employee to harass the Plaintiffs for several minutes before doing anything. The Plaintiffs eventually had to involve the Police.
The complaint is alleging Best Buy violated the Americans with Disabilities Act (ADA) because one of the Plaintiffs had a disability to which Best Buy was aware. Best Buy interfered with the Plaintiff’s ability to purchase goods in violations of the ADA. The complaint also alleges that Best Buy was negligent in the supervision of its employees. Best Buy allowed its employee to harass Plaintiffs for several minutes before doing anything – and that was after the Plaintiffs called for a Manager. If Plaintiffs had not called for a Manager the harassment could have lasted longer.
