Kraemer, Manes & Associates LLC “KM&A” has filed a complaint against CSX Transportation on behalf of Eric Arroyo in the United States District Court for the Western District of Pennsylvania.
The complaint alleges that the Plaintiff, a Puerto Rican male, was discriminated against by CSX Transportation by treating him differently than the other Caucasian train engineers employed there. The complaint claims that the Plaintiff was terminated from his position after a minor infraction; meanwhile numerous other Caucasian engineers had received suspensions and offered waiver opportunities for the same or more serious infractions as the Plaintiff. The complaint asserts that the alleged infraction was the Plaintiff’s first discipline in his seventeen years working for CSX Transportation. The complaint also alleges that Plaintiff was denied his earned seniority in regards to weekend “rest days.” The complaint further alleges that the Plaintiff was not offered the same disciplinary forgiveness as the other Caucasian employees because he is Puerto Rican. The complaint alleges that the defendant has violated Title VII, as the Plaintiff is a member of a protected class under Title VII and the PHRA.
