Employee Files a Complaint against DaVita at Conemaugh Memorial Medical Center for Sex Discrimination
Management at DaVita and Conemaugh Memorial Medical Center ignore reports of sexual harassment and continue to schedule harasser and victim together.
Pittsburgh, PA, June 20, 2017 – Kraemer, Manes & Associates LLC “KM&A” has filed a complaint for sex discrimination and hostile work environment against DaVita at Conemaugh Memorial Medical Center, for the Western District of Pennsylvania.
Within weeks of beginning her job, Plaintiff experienced inexcusable sexual harassment from a coworker at Conemaugh Memorial Medical Center. When she reported the many instances to her supervisor, she received no relief. Plaintiff’s harasser increased his lewd behavior towards her, placing her in unsafe work conditions until she was forced to quit.
The sexual harassment began almost immediately. The coworker’s behavior towards Plaintiff was disgusting and unlawful. At one point, the coworker pushed himself up against Plaintiff as she bent over a patient. Plaintiff immediately moved away and faced the coworker, who gestured to his genitals and said, “I thought maybe you should know what you’re doing to me while we’re working.” Plaintiff informed him that his sexual advances were inappropriate and unwelcome. Throughout the following week, Plaintiff spoke up against this coworker’s regular sexual advances. Despite this obvious sexual harassment, when Plaintiff reported the coworker’s behavior to her supervisor she did nothing to help and simply replied that she would “deal with this later.”
After Plaintiff complained to her supervisor, the coworker became aggravated and she suffered not only increased sexual harassment but also retaliation. Once again, Plaintiff sought help from her supervisor. Nothing was done. Plaintiff continued to be scheduled with her harasser, forced to work with patients without appropriate training, and endured derogatory comments about her sex. The harassment was so serious that Plaintiff began to suffer severe anxiety and symptoms of Post-Traumatic Stress Disorder (PTSD). Plaintiff’s doctor prescribed her a medication to help with these side effects of dealing with sexual harassment and a hostile work environment.
Plaintiff sought to resolve the issue, but the supervisor hung up on her. Since the company knowingly neglected to correct the situation, Plaintiff left her job for her physical, emotional, and mental safety. No employee should suffer this type of disrespect in the workplace.
