Kraemer, Manes & Associates LLC “KM&A” has filed a complaint against Michael A. Rabel, Esquire and Michael A. Rabel & Associates, LLC in the Allegheny County Court of Common Pleas.
The complaint alleges that the Plaintiff was not properly compensated for working under the Fair Labor Standards Act of 1938 (FLSA) or the Wage Payment Collection Law (WPCL). The complaint states that the Plaintiff worked well over 40-hours per week and was not being paid overtime. When you take the amount of hours Plaintiff worked and divided it by his weekly pay, Plaintiff’s average hourly rate would be $3.75/hr. Plaintiff was not being properly compensated under the FLSA. Plaintiff has also not been compensated for several weeks that he did work.
Plaintiff has tried to collect his money but both Michael A. Rabel, Esquire and Michael A. Rabel & Associates, LLC have refused. Both are in clear violation of the FLSA, which guarantees the Plaintiff overtime for any hours worked over 40 hours per week, and the WPCL, which requires the Plaintiff be paid for hours worked.
