African-American Files A Complaint Against Mosebach for Discrimination
Abrupt Termination from Employment Leads Man to Believe Race and Disability Discrimination Occurred.
Pittsburgh, PA, June 5, 2017 – Kraemer, Manes & Associates LLC “KM&A” has filed a complaint for race and disability discrimination against Mosebach Manufacturing Company for the Western District of Pennsylvania.
The complaint centers on Plaintiff, an African-American, who became temporarily disabled after an unfortunate car accident. Only a few African-Americans work at Mosebach, which included plaintiff—that is before he was fired. Plaintiff alleges he was wrongly discriminated against because of his race and disability after he was fired only one day after suffering from injuries in a car accident. Additionally, Plaintiff’s employer violated the FMLA when they fired him in response to him taking leave.
Before the car accident, Plaintiff regularly suffered from discrimination, perpetrated by his supervisor, because of his race. After Plaintiff’s supervisor obtained his position, Plaintiff was targeted from that point on. Plaintiff’s supervisor undermined his authority and turned subordinate employees against Plaintiff because of his race.
On the day of the car accident, Plaintiff called his supervisor to let him know he had been injured in an accident and he would not be able to go into work that day. The next day, Plaintiff called off from work to go to a doctor’s appointment for his injuries. Later that night, Plaintiff’s supervisor called him saying he was fired, allegedly because his “work product was unsatisfactory.” Plaintiff’s supervisor was fully aware of Plaintiff’s temporary disability, and yet he blatantly failed to offer him his right to accommodations. Clearly, Plaintiff was discriminated against because of his disability as he was fired a day after he became injured in his accident and he has no history of poor work performance that could have led to his termination.
