Employee Files a Complaint against Pittsburgh Field Club for Disability Discrimination
Employee suffers work-related injury and endures harassment from supervisor before being fired only a month after return.
Pittsburgh, PA, June 12, 2017 – Kraemer, Manes & Associates LLC “KM&A” has filed a complaint for disability discrimination against Pittsburgh Field Club, for the Western District of Pennsylvania.
A man employed for almost five years with Pittsburgh Field Club for upkeep of buildings suffered a work injury when he fell down concrete stairs while cleaning up alone after the repair of a fire sprinkler pipe burst. After receiving medical care from three different doctors and scheduling a hip surgery with approved leave, Plaintiff continued to work with heavy restrictions, including no use of ladders, squatting, or lifting over 10 pounds. Meanwhile, Plaintiff filed for and received workers’ compensation.
A little over a month after surgery, Plaintiff received doctor clearance to return to work with the same heavy work restrictions provided above. Plaintiff forwarded all medical paperwork to employer. Upon returning to work, Plaintiff met an under-qualified employee who had been hired to “help out” while he was gone. Plaintiff sensed pressure to quit.
“Can’t you do this any faster?” Supervisor pestered Plaintiff. “There’s two people on the job, why does it take so long to do this?” The supervisor also called Plaintiff into a series of meetings, accusing him of harassing other employees and of not being a team player. Not even a full month after returning from leave, Plaintiff was fired.
Pittsburgh Field Club demonstrates a questionable history where injured employees left or were terminated within weeks of returning to work. Furthermore, Pittsburgh Field Club failed to offer accommodation to Plaintiff and also permitted the occurrence of a hostile work environment, retaliation, and wrongful termination. This pattern in a company disregards the law.
