Kraemer, Manes & Associates LLC filed suit against Sodexo, Inc. on behalf of David Ripley in the Court of Common Pleas of Allegheny County, Pennsylvania. The complaint alleges that on Mr. Ripley’s application as a Cook for Sodexo at the University of Pittsburgh location in 2010, he indicated that he had no criminal record as his parole officer informed him that there was no record of his conviction and that it had been erased. The complaint alleges that Mr. Ripley passed annual background checks until 2012, when Sodexo implemented a new FBI background check which revealed Mr. Ripley’s conviction in 1975, which led to Mr. Ripley’s termination on November 9, 2012 due to a prior conviction over three decades before. The complaint alleges that Sodexo’s employment practice disparately impacted African American employees, that Mr. Ripley was terminated because of these policies in violation of Title VII of the Civil Rights Act, in violation of the Pennsylvania Human Relations Act, and wrongfully discharged him in violation of the Pennsylvania Criminal History Record Information Act.
