Man accuses AHN of discrimination

For immediate release

PITTSBURGH – A Pennsylvania man has accused Allegheny Health Network, Forbes Regional Hospital, and West Penn Allegheny Health System, Inc. of failing to hire him based solely on his physical disability and age.


According to a civil complaint filed in the Western District Court of Pennsylvania, Plaintiff Gary Still applied for a position at Forbes Regional Hospital and, on the same day, participated in a phone interview for the position. During the interview process, Mr. Still was asked about his ability to lift heavy objects, and, due to his heart disease disability, he said that he needed to check with his physician, according to the report.

Mr. Still alleged in the filing that he was asked no further questions. According to the complaint, he was later informed that he was not selected for the position. Lead Attorney David Manes asserted in the filing that Mr. Still was “well qualified” for the job and was not offered a non-discriminatory reason as to why he was not considered for the position.

According to the complaint, Mr. Still applied for approximately nine other positions within the Allegheny Health Network after he disclosed his age and heart condition in the initial interview. On several occasions, Mr. Still was informed by AHN officials that positions had already been filled; however, at least four times, the jobs remained posted as available, according to the complaint. Mr. Still alleged that he applied for numerous positions over the course of several years, but was never provided with a non-discriminatory reason for the company’s refusal to hire him.

The three-count complaint alleged discrimination and retaliation in violation of the Americans with Disabilities Act and the ADA Amendments Act of 2008, discrimination in violation of the Age Discrimination in Employment Act, and violations of the Pennsylvania Human Relations Act.

Prior to the filing of the lawsuit, Mr. Still filed a complaint through the Equal Employment Opportunity Commission and was provided a right to sue.
