Woman alleges she was terminated after requesting FMLA

PITTSBURGH – A Pennsylvania woman has filed suit and alleged that she was terminated about one week after she requested leave through the Family and Medical Leave Act of 1993.


According to a complaint filed in the Western District Court of Pennsylvania, Plaintiff Toni Flaherty began working for KRG Kings, LLC in October 1995. She was eventually promoted to Assistant General Manager, according to the complaint.

Ms. Flaherty alleged that, in December 2018, she informed her General Manager, Shane Roper, that she needed to use FMLA for about one month in order to care for her sick father. According to the filing, Mr. Roper told her that she was required to discuss her need for FMLA leave with District Manager, Mike Calabrese. She did as she was instructed, and she was informed that management would fill out the required paperwork, according to the complaint.

However, she alleged that, within the next week, Mr. Calabrese terminated her position. According to the complaint, he told Ms. Flaherty that he was “making cuts” and her position was one of the “cuts.” He further stated that her termination would “help her since she wanted to take FMLA to help her father,” according to the filing.

The three-count complaint alleges discrimination, retaliation, and interference in violation of FMLA.

Prior to the filing of the lawsuit, Ms. Flaherty filed a complaint through the Equal Employment Opportunity Commission and was provided a right to sue. The lawsuit was filed on September 9, 2019.
