Work-Related Back Injury Forces Employee to Call Off and She is Fired.

Employee Files Lawsuit against TE Connectivity Corporation for Disability Discrimination

Stephanie joined TE Connectivity Corporation as an assembly worker in April 2014. Three years later, she suffered a lower back injury while on the job in the beginning of January. She immediately reported the injury to the plant nurse. The following weeks, Stephanie sought treatment from the plant nurse, but she finally requested to see the Workers’ Compensation doctor about her injury.

About two weeks after her initial injury, Stephanie was diagnosed with a lower back sprain and spondylosis. Her injury limited her ability to stand, walk, and work. She requested light duty, and she was granted the accommodation immediately. However, the new assignment aggravated her injury still so Stephanie was moved to sorting.

Despite continuing to experience pain from her injury, Stephanie worked. Sorting required her to sit for long periods of time, and it aggravated her back. She reported the situation to the HR and plant nurse. Although she was still cleared for light duty, the pain in Stephanie’s back forced her to leave work early and call off a few times in the space of two weeks.

At the end of those two weeks where Stephanie had to leave work due to her back injury, she was terminated. The reason for her termination stemmed from her violation of the attendance policy.

Stephanie suspects that she was terminated due to her injury and her request for reasonable accommodation. After all, her absences occurred because of her injury.
